The ICC is taking a formal stand against the oppression of girls and women - as well as members of the LGBTQ community. (Credit: Wikimedia Commons) This week, the International Criminal Court issued arrest warrants for two Taliban leaders for their years-long subjugation of girls and women throughout Afghanistan. The officials – Taliban supreme leader Hibatullah Akhunzada and Supreme Court head Abdul Hakim Haqqani – stand accused by the ICC of ““severely depriving, through decrees and edicts, girls and women of the rights to education, privacy and family life and the freedoms of movement, expression, thought, conscience and religion.” The court added: “Other persons were targeted because certain expressions of sexuality and/or gender identity were regarded as inconsistent with the Taliban’s policy on gender.” ICC chief prosecutor Karim Khan began pursuing the warrants earlier this year, because “Afghan women and girls, as well as the LGBTQI+ community, are facing an unprecedented, unconscionable and ongoing persecution by the Taliban,” he said in a statement. We’ve seen examples of this gendered persecution over the years: Taliban restrictions issued on girls’ and women’s learning opportunities, livelihoods – even how they use their voices. It has been so ever since the extremist group took back control of the central Asian nation in August 2021. Punishments for refusal to comply with their draconian restrictions range from intimidation and confiscation of property to imprisonment, flogging – and worse. Which is why numerous international human rights organizations are celebrating the warrant. Amnesty International Secretary General Agnes Callamard told CNN that this was “a crucial step to hold accountable all those allegedly responsible for the gender-based deprivation of fundamental rights to education, to free movement and free expression, to private and family life, to free assembly, and to physical integrity and autonomy.” The ICC does not have its own police force, and as such relies upon the 125 nations who have signed and ratified the Rome Statute that established the ICC to enforce such edicts and bring suspects in for trial. The U.S. is not among that list, having signed the statute in 1998 before withdrawing support in 2002. George W. Bush’s administration cited concerns regarding lack of recourse for arrests and prosecutions of U.S. military and political leaders among its reasons. But no matter how long the next steps of the process may take, or who steps up to complete the arrests, Afghan women have already shown great strength through acts of defiance during the Taliban’s latest rule: Participating in the 2023 Asian Games, and learning in secret, among other examples. When we spoke with several Afghan women in 2023 about their experiences, educator Munireh explained that while she fears the Taliban, and she fears retribution for her decision to stay and teach, she fears the long-term oppression of her Afghan sisters more. “I don’t like it. We should not accept it,” she stated. “I believe that tomorrow they will say a woman should not come out of her home. Anything is possible. And that’s why if someone tells me to come and protest, I accept.”
